Client Introduction to AWR
&nbsp;

&nbsp;
Following many years of debate in Brussels, the AWR (Agency Workers Regulations) come into force in England, Wales and Scotland on 1st October 2011.
&nbsp;
The aim of the regulations is to ensure that the principle of equal treatment, which already applies to fixed-term and part-time workers, is extended to Agency staff once they have completed a 12 week qualifying period.
&nbsp;
Equal treatment measures cover pay and working conditions but this does not affect employment status or the dynamics of how agency staff are placed and managed. Morestaff&rsquo;s aim is to work with you to minimise any impact on the effective supply of flexible workers.
&nbsp;
There are two main factors that need to be addressed in readiness for the new legislation&hellip;
-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Factor 1 - Day One Rights
-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Factor 2 - The Twelve Week Qualifying Period.

Factor 1 &ndash; Day One Rights
From &lsquo;Day One&rsquo; on an assignment an agency worker has the right of equal access to &ndash;
&nbsp;

    Collective facilities and amenities
    Information about any relevant vacant posts within the hirers organisation

&nbsp;The hirer is responsible for providing equal treatment for &lsquo;Day One&rsquo; entitlements and is liable for any breach.
&nbsp;
Factor 2 &ndash; The 12 Week Qualifying Period
After an Agency Worker completes a 12 week qualifying period with the same hirer, in the same role, they will be entitled to have the same basic terms and conditions of employment as if they had been employed directly by the hirer.
&nbsp;
These basic terms are &ndash;





    Key elements of pay
    Duration of working time
    Shift / Night work
    Rest periods
    Rest breaks
    Annual leave 
    Paid time off for ante natal appointments


Calculating the 12 week Qualifying Period &ndash;

    Week 1 of the QP will only start to accrue from 01/10/2011 &ndash; not retrospectively
    Will only accrue if the role is the same or substantively similar
    Accrues regardless of whether one or more agencies supply the Agency Worker
    Will accrue irrespective of how many hours worked &ndash; can be as little as 1 hour
    Stops accruing if the Agency Worker finds alternative employment and does not return for at least 6 weeks
